Flashpackers Website Terms
These terms govern the use of flashpackers.pl, tools that help you choose a trip, forms, consultations and the newsletter. Selecting a suggestion or submitting an enquiry does not constitute a travel booking. Bookings are made through a separate process handled by a consultant, based on a personalised offer and booking documents.
Version 1.1 • publication date:
1. Operator and contact details
The website operator and provider of the electronic services described here is Flashpackers (PVT) LTD, a limited liability company incorporated and registered under the laws of the Democratic Socialist Republic of Sri Lanka, with its registered office at Lewis Place 222, 11500 Negombo, Sri Lanka, registration number PV00310133, TIN 169060312, referred to as “Flashpackers”. The Polish domain, website language and Polish contact number serve users and do not mean that the service provider is a company incorporated under Polish law.
Contact: hello@flashpackers.pl, telephone +48 795 520 224, or by post to our registered office. For personal data matters: privacy@flashpackers.pl.
“User” means a person using the website. “Suggestion” or “result” means a preliminary travel option presented on the website. “Booking documents” means documents provided in the separate booking process, in particular the offer, booking form, pre-contract information and General Terms and Conditions of the Travel Contract (referred to as “OWU” in Polish).
2. Services and scope of use
The website provides information about Sri Lanka, attractions and travel options. It enables users to use available tools for selecting suggestions, submit an enquiry, arrange a consultation and subscribe to the newsletter. The website interface shows which features are currently available.
Use of the website, suggestion tool, contact form and newsletter is free. A paid service can be ordered only separately, after its scope, price and terms have been presented. Simply browsing the website or submitting an enquiry creates no obligation to pay.
No user account is required. The content-display service lasts for the duration of website use. The form service includes receipt and handling of the submitted enquiry. Later sections explain the duration of access to results and the newsletter.
A contract for an electronic service is concluded when the user starts using the available feature, in particular by successfully submitting a form or requesting a result, after being given the opportunity to read these terms. The newsletter requires the additional confirmation described in section 8.
We make these terms available free of charge in a form that allows them to be saved and reproduced before use of the relevant service begins.
3. Technical requirements and security rules
You need an internet-connected device and an up-to-date browser. Interactive features may require JavaScript; receiving messages, a results link and the newsletter requires a functioning email service. Connection charges are governed by your agreement with your internet provider.
Privacy settings, blocking external content or browser restrictions may affect embedded videos and the consultation calendar. If you have difficulties, you can contact us by email. We do not require you to disable device protection or accept optional tracking to submit an ordinary enquiry.
You must not provide unlawful content, impersonate others, send spam, attempt unauthorised access to data or disrupt the website. Do not provide other people's data without an appropriate basis and their knowledge.
In response to specific misuse, we may restrict the associated access to the extent necessary to protect the website and other users. Where possible without compromising security, we will explain the reason and how to contact us about the restriction.
4. Information about attractions and suggestions
Descriptions of places, itineraries, journeys and attractions help you plan a trip. Local conditions, weather, seasonality and availability may affect whether an option can be delivered. The material terms of a particular trip are set out in a personalised offer.
The suggestion tool uses your answers to present options for further discussion. A result does not confirm the availability of hotels, tickets or other services and does not replace a consultant's assessment of the itinerary.
An attraction description is not an individual medical assessment or confirmation of the fitness or qualifications needed to take part. Tell your consultant about relevant limitations in the manner indicated when information about special requirements is collected.
If we display an indicative price, a “from” price or a range, we identify its nature and main assumptions, particularly the pricing unit, currency and included services. The final price and scope require individual confirmation. This does not alter binding terms of an existing contract or responsibility for information given binding effect by applicable law.
5. Results and access links
If you request a result by email, we send a link to the address provided. It remains valid for 30 days from generation; reopening it does not extend that period.
Anyone who has the link can access the result. Do not share it with people to whom you do not wish to disclose your travel suggestion. The result may include your first name, dates and preferences, but does not display your last name, email address or telephone number.
After the link expires, you may ask a consultant to prepare or share a suggestion again. A new suggestion may require updated availability and pricing. We do not provide a button for you to revoke a link yourself; contact us if it is disclosed or if you need to request deletion of data.
The link's availability period is not the validity period of a binding offer or a payment deadline unless separate documents expressly state otherwise.
6. Enquiries and consultations
The form lets you submit an enquiry and the details needed for a reply. An automated acknowledgement confirms receipt by the system, not acceptance of a booking or of a proposed price or travel date.
You can arrange a consultation through the available TidyCal calendar or by contacting Flashpackers. The terms of the particular meeting, including its time, connection method and any charge, must be presented before it is ordered. Use the tool provided in the confirmation or email us to request a change or cancellation.
We do not use consultation or enquiry details for the newsletter without separate consent. Please provide current contact details, as otherwise a reply may be impossible.
7. Proceeding to a booking
After discussing your needs, the consultant prepares a personalised offer and documents for the particular trip. Before entering into a contract, you receive information about the service provider, scope, price, payments, cancellation, complaints and other material terms applicable to that offer.
The contract is concluded according to the rules in the booking documents provided. Submitting a form, selecting an option, subscribing to the newsletter or arranging a consultation does not in itself conclude a travel contract.
These website terms do not replace the General Terms and Conditions of the Travel Contract (OWU) or change existing bookings. Paid planning, transport, accommodation and other travel services require their scope and terms to be specified separately. Nothing in these terms restricts mandatory consumer rights.
8. Newsletter
Where newsletter sign-up is available on the website, the following rules apply. The newsletter is a free email service offering inspiration about Sri Lanka and information about Flashpackers trips and offers. Frequency depends on the materials prepared; we do not guarantee a particular number of messages.
Subscription requires an email address, freely given consent to the newsletter and confirmation of the address through a link in an email. The newsletter contract is concluded when the subscription is confirmed. Unconfirmed sign-ups are deleted after 30 days.
The newsletter service continues for an indefinite period. You can end your subscription at any time, without giving a reason, paying a charge or logging in, using the unsubscribe link in an email or by writing to us. Unsubscribing stops marketing and does not affect the handling of a separate booking.
After 24 months from the last confirmation of interest, we request confirmation again; if no response is received within 30 days, sending stops. We do not automatically subscribe people from our customer database.
We may discontinue the newsletter by notifying active subscribers at least 14 days in advance. If an address is permanently undeliverable or there is specific misuse, we may stop sending to that address sooner, to the extent necessary.
9. Ending services and consumer rights
You can stop using the website at any time. You can email us to request that we stop handling an enquiry or delete a result. This does not automatically cancel a separate travel contract or delete records that we must continue to retain.
For the electronic services covered by these terms, we grant consumers a right to withdraw within 14 days of concluding the contract, without giving a reason or incurring charges. You can send your notice to hello@flashpackers.pl or our registered office. Sending it before the deadline is sufficient. This does not restrict your right to end a free service at any later time or any more extensive statutory rights.
Example notice: “I withdraw from the contract for [service name] concluded on [date]. Full name: […]. Email address used for the service: […]. Date: […].” A signature is required only for a paper notice. Use of this example is optional.
If applicable law on digital content or digital services applies, you retain the rights it provides concerning delivery and conformity with the contract. You may request that the service be brought into conformity and, in the circumstances specified by law, withdraw from the contract or, if you paid for the service, request a price reduction. The service is brought into conformity free of charge, within a reasonable time and without significant inconvenience. Being free does not in itself exclude these rights. If the service has not been supplied, you may call upon us to supply it and exercise the right to withdraw on the conditions set out by applicable law. Withdrawal from a separate travel contract is governed by the applicable law and that contract's documents.
10. Content and rights of use
Website materials, including text, photographs, videos and other works, may be legally protected. You may view them and use them for your own trip planning, subject to rights provided by law, including permitted use.
Without appropriate permission, you must not commercially reproduce or publish protected materials beyond what the law permits. Sharing an ordinary link to a public webpage does not require our separate permission. This does not apply to a confidential link to an individual result, which you should handle in accordance with section 5.
Sending an enquiry or material needed to prepare an offer does not transfer to Flashpackers rights to use it for public promotion. Use of your image or private materials for marketing requires a separate legal basis.
11. Website complaints
You can report problems with the website, results, newsletter or a consultation to hello@flashpackers.pl or our registered office. Describe the problem, when it occurred and how we can reply. A screenshot may help but is not required.
We respond to complaints within 14 days of receipt, by email or another agreed durable medium. If clarification is needed, we will ask for it; this does not restrict deadlines or consequences set out by applicable law.
Complaints about trip delivery are handled under the relevant contract and law. If sent to the contact above, we forward them for appropriate handling; we will not reject them solely because a particular form was not used.
Consumers may seek help from the competent consumer ombudsman and information from Poland's Office of Competition and Consumer Protection (UOKiK) about out-of-court dispute resolution. The competence of an authority or dispute-resolution body depends on the matter and the parties to the contract.
12. Availability and liability
We take care to maintain the website's operation and keep it up to date. Interruptions may occur due to maintenance, updates or failures. Where possible, we give advance notice of a planned significant interruption. If the form is unavailable, you can contact us by email.
We do not exclude Flashpackers' liability for its own acts, improper performance of a service or infringement of users' rights to the extent provided by law. Using an external provider does not release us from liability we owe to the user.
The indicative nature of a result does not entitle us to change the price or itinerary at will after a contract has been concluded. Changes to agreed terms are governed by the relevant contract and applicable law.
13. Personal data
The Privacy Policy available on the website explains the purposes, legal bases, recipients and retention periods for processing, and your rights. Acceptance of these terms does not replace marketing consent or explicit consent to processing health data where required.
14. Changes to these terms
Changes may result from changes in law, the addition or alteration of features, a change of operator or contact details, necessary technical or security changes, or clarification of an ambiguous provision. The extent of a change should correspond to its stated reason.
We publish a new version with its effective date. For an ongoing service such as the newsletter, we notify users of a material change on a durable medium at least 14 days before it takes effect, stating the reason and the right to end the service without charge. A shorter period may result only from the need to meet a legal obligation or urgently protect security; we explain this in the notice.
Where digital-services law applies, we make changes beyond those needed to maintain conformity only as permitted by that law and without additional cost. If a change significantly and adversely affects access to or use of the service, we give advance information on a durable medium about the change and the statutory right to terminate the contract; we do not replace that right with a shorter period under these terms.
We do not apply changes retrospectively to completed services or separate bookings. Publishing new terms does not itself obtain fresh marketing consent. We retain previous versions so that the rules applicable at a particular time can be established.
15. Company status and language versions
Flashpackers (PVT) LTD is a company incorporated under Sri Lankan law. This identifies its country of incorporation and registration; it does not in itself reserve exclusive application of Sri Lankan law to every user and service.
Translations of content originally prepared in English into Polish or other languages are provided solely to make the website and information about our services easier to use and understand. Providing a translation does not change Flashpackers' identity or country of registration. If versions differ, the English version may help clarify the meaning where it has been provided as the source version. This does not exclude the binding effect of information provided to the user, information obligations or consumer protection under mandatory applicable law. We do not interpret unclear contractual provisions to a consumer's disadvantage solely because of a difference between language versions.
You can correspond with us about the website, complaints and personal data in Polish or English. We identify the language and documents for a particular booking before the contract is concluded.
16. Final provisions
These terms do not impose exclusive jurisdiction of Sri Lankan courts on consumers or deprive them of protection granted by mandatory provisions of the law applicable to their circumstances.
If a provision cannot apply, this does not restrict statutory rights or the remaining provisions to the extent permitted by law. You can send questions about use of the website to hello@flashpackers.pl.
